Delaware Debates Bill to Expand Government Transparency
Delaware Considers Reforms to State Transparency Law
Delaware's Senate Majority Leader Bryan Townsend introduced a comprehensive Freedom of Information Act (FOIA) bill last week, aiming to enhance government transparency in the state. This proposed legislation, Senate Bill 355, includes numerous new provisions intended to update the 50-year-old statute. Among its key changes, the bill would bring the University of Delaware and Delaware State University under the purview of the state's FOIA requirements.
Historically, the transparency of these universities, particularly the University of Delaware, has been a significant point of discussion in the state. A notable past instance involved a 2021 Supreme Court ruling that allowed the University of Delaware to deny a records request, a decision that Senate Bill 355 directly addresses by seeking to remove the relevant exemption in the existing law.
Other important provisions in the bill would prevent government officials from automatically withholding investigative documents and remove fees for FOIA requests made by certain individuals, such as reporters and academics. Townsend noted that some public-interest records requests have been stalled due to the current investigatory shield. Source: newsfromthestates.com
